On the 9th of DEC my vento vr6 MOT ran out, as i couldnt get the car into the garage till the 11th i left my car off the road. On the 11th i drove to the MOT test station and the car failed due to warped rear disks and front tyres. so i had the brakes fixed in garage and then was on my way to get some tyres when stopped at a red light and someone drove into the back of me. (light rear damage quote of £370 to fix) so exchanged details etc. Then went on the way to garage got new tyres but didnt have time to return to MOT station till the next day (left car at garage overnight). Basically can the other drivers insurance company screw me over due to having no MOT? i thought it will be ok as i was only driving to get car fixed? my mechanic said there is a possibility i would have to pay because i didnt have valid MOT at time of crash? sorry for the long post. spindat45 0 Posted December 13, 2006 Report Share Posted December 13, 2006 A bit of a grey area mate. You are allowed to drive your car to a MOT test station providing its booked in with them. As long as your insurance was valid on the day of the accident and you were on your way to have the car tested you should be covered. I'm not 100% sure but I think it is unlikely that the other persons insurance company will ask you to produce a valid MOT certificate for that day but with the new MOT system, all information is stored on a central database. If your old MOT was the new A4 print-out type then they will probably be able to access that info if necessary. I would proceed with the claim as normal and see what happens. If they do question the validity of your MOT, the test staion should back you up providing it was "officially" booked in with them.Best of luck.Kevin Link to post Share on other sites

They (I am only assuming mind you) shouldn't even know you were in change over period of getting MOT and travelling TO the garage at the time. There is a period of 7 days I believe by law if your car fails mot to get the failed areas fixed - but as above I think this is a grey area. But I am only assuming in all this. dagovernor 0 Posted December 14, 2006 Author Report Share Posted December 14, 2006 Thanks for the replies. ps it was 11DEC not may!The car had tax and insurance and got the MOT the day after. on the back of the MOT form it says as long as a previous arrangement was made with the place of repair it should be ok. good job i rang the tyre place to find out where they were! Only problem is that the MOT test i failed was in the morning (11Dec) and after the accident and fitting new tyres the MOT place was closed so MOT is computerised and starts from the 12Dec.Just looks bit suspect. i wont mention MOT unless asked about it.just my luck lately, not much damage but it was my cars and my first accident so was shocked and really annoyed as the other car was a buliders work horse and the driver didnt care. purple highline monster 0 Posted December 14, 2006 Report Share Posted December 14, 2006 its all by the buy, if some twat hit you in the back at traffic lights its their liabillity period, as said they cant know where you were going and as you say a pre arranged mot test is an acceptable reason for driving your car the main issue is you are insured at the time, unless someone was seriously injured then i doubt anyone is gonna deal with the incident other than section 170 of the Road Traffic Act is complied with, ie you have exchanged details with the other driver at the roadside at the time of the accident, only details you need to give are name, address and contact number, reg number, if you know your insurer that helps but its not necessary as insurers persue uninsured drivers, thats why we pay such high premiums!!!!! gav_113 0 Posted December 14, 2006 Report Share Posted December 14, 2006 i was hit from behind in my escort cab, the other person was at fault, my car was insured as a std 16i, but infact it was a 200bhp rs turbo conversion, car was very modded and was sprayed white with violet flip. none of the insurers asked for any details about tax and mot.. so u might be lucky...
