The Absinthe Fairy 0 Posted August 16, 2004 Report Share Posted August 16, 2004 Hiya-My baby golf has picked up points!Not by ME I hasten to add....but does anyone know the legality of this- maybe someone has experianced this.OH and I in my Golf, lights went amber but OH drove through as you do when you won't make the stop.Got pulled by police woman who was at left hand side of the juction.He got 3 points and £60 for running a red. It wasn't red! Her deduction for this was becasue a car on the other side coming the otherway form us had in fact stopped as we went through.She could NOT see our traffic light form where she was.She was on her own in the car- no camera- no other witnesses.She then said OH had to decide on the spot whther to accept the points&fine or go to court. Question is- being her word against ours can we protest? Also is she allowed to make OH make an instant descision without being able to consult legal advice?( Also- the first thing she said was- "Ok- why didI pull you and NO bullshit" !! Can police swear at member of the public!! Appalling!)The general consensus is that amber means stop and punishment should be taken graciously- but Adam has other ideas cos it takes him up to 9 points- that's what having GTO does for ya.xclairex Link to post Share on other sites

But you'd have to fight hard to over turn the police!Amber means proceed with caution, so it's not technically illegal to drive through!I been in court recently re. Car accident along similar red light lines, the crash wasn't my fault and I went through on amber......however still got rolled over! I did myself no favours going to court on my own! andy 0 Posted August 16, 2004 Report Share Posted August 16, 2004 If the polocewoman couldn't see the lights from where she was then there is no way you should be accused of running a red light. Also you only have to stop at an amber light if you consider it safe to do so, if you don't think you can pull up safely then you should continue through. She definately should not have sworn at you, it's as unprofessional as her judgement. I think by saying that you have to accept the fine/points or go to court is their way of making you admit guilt there and then, any appeal, if possible already looks like sour grapes on your part in a court. If it wasn't red and you really know it wasn't red I would get some advice, a friend of mine got a speeding ticket overturned because he knew he was in the right. See if you can appeal. Don't think about representing yourself, it just looks like you're not taking things seriously and are too tight to hire a solicitor, as well as too tight to accept the fine! Good luck... blackburnvr6 0 Posted August 16, 2004 Report Share Posted August 16, 2004 i got done this way last year wish i had tryed to overturn it now i no put the plod has to see your wheels go over the line as it turns red so if they not got a clear veiw then fight it mine was super cop cause he saw through 2 cars and loads of railings he said he new i went through cause his light changed but getting him to admit he said that in court was an none starter so they need a clear veiw of the line!![ Edited Mon Aug 16 2004, 06:15PM ] Link to post Share on other sites
